But with so much promise comes also the risk of bias, transparency, and ethics problems.   • Consistency: Human judgments differ enormously based on the judge, jurisdiction, or even the time of day. AI, modeled on consistent data sets, can propose decisions that minimize discrepancies in decisions.
  • Accessibility: Chatbots and legal assistants powered by AI bring legal advice within reach of people who cannot afford the usual legal advice, potentially democratizing legal service.
  • Resource Optimization: Courts are overworked and short-staffed, and AI can be used to alleviate routine tasks so that human specialists can handle more complicated issues.

These advantages make AI highly desirable, especially for overloaded judicial systems.

The Risks: Bias, Opacity, and Over-Reliance

However, with these advantages come great risks that question the notion of AI as an impartial administrator of justice.

  • Algorithmic Bias: AI is only as good as the data upon which it is trained. If past data are biased (racial, gender, socioeconomic), then AI can perpetuate and even enhance these inequalities. COMPAS studies, for example, found that it overclassified Black defendants as high risk versus white defendants with similar backgrounds.
  • Opacity and the “Black Box” Problem: Most AI systems are black boxes, offering solutions without explanation of how they arrive at a conclusion. This kind of transparency is the reverse of what justice principles demand, namely that a decision should be understandable and auditable.
  • Failure to Account: What happens if a judge relies on a faulty AI recommendation? Who’s responsible, the coder, the vendor, or the judge? Courts are not yet ready to answer such questions to any extent.
  • Over-Reliance on Technology: Judges and lawyers might put too much faith in AI software, assigning it a greater importance than it deserves. This will result in the decline of human judgment and critical thinking in the courtroom.

Real-World Case Studies

AI in courts is not just hypothetical. Various jurisdictions have already started implementing AI software:

  • United States: COMPAS is used in a number of states for parole and sentencing risk assessment. Yet, its effectiveness and fairness have been controversially discussed, especially following a 2016 ProPublica report that brought to light racial biases.
  • Estonia: In an ambitious experiment, Estonia introduced a “robot judge” to rule on small claims cases worth up to €7,000. Though it deals with only simple cases, the pilot project is being monitored closely for wider implications. 
  • China: With one of the most advanced legal systems globally, China has created “smart courts” that are rooted in facial recognition, voice-to-text transcription, and AI-based judgments for minor cases.

Using AI in the courtroom is fraught with basic ethical concerns. Can a machine decide matters that will impact an individual’s freedom, family, or professional life? Even if AI can be positive, can it ever substitute human judgment?

Judges can use AI to check for consistency in sentences, detect legal anomalies, or automate administrative tasks. Lawyers can rely on AI for instant legal research or case precedent checking. However, the moral and interpretive essence of justice should be firmly under human control.

In order to make this partnership work, legal professionals need to be invested in AI literacy to help them know what they’re working with. Judicial institutions should also demand transparency and fairness from the vendors of AI and hold them to high standards.

Public Trust and Perception

A justice system must not only be fair but be seen to be fair. Perception by the public of AI in court has a big influence on its legitimacy. If the public perceive that machines are deciding fates without openness or accountability, faith in the justice system can be eroded.
